Data Terms
These Data Terms supplement the EcosAtlas Terms of Service and govern licensed business information, samples, exports, custom datasets, and research deliverables. The applicable order defines delivery and use rights.
1. Relationship to other agreements
EcosAtlas Data includes licensed business records, source fields, classifications, derived matches, exports, samples, custom datasets, and research deliverables. It excludes your pre-existing rights in customer-supplied information. These Data Terms control data-license matters under the Terms of Service; an applicable signed order controls expressly varied rights. The order identifies the deliverable, purpose, users and recipients, geography, fields, format, delivery or refresh schedule, license duration, retention, and relevant source restrictions. A data-processing agreement controls customer-directed personal-data processing within its scope.
3. Permitted outputs
Within the licensed purpose, you may prepare internal analysis, lists, summaries, and presentations. An order for client, board, member, or public-facing work must specify the permitted recipients and whether they may receive conclusions, excerpts, or licensed records. Required attribution and source restrictions continue to apply. Ordinary work product that does not expose restricted records or substitute for the data is distinct from a redistributed dataset. Publication of a dataset, directory, map, or ongoing data product requires express rights; commissioning a report alone does not grant them.
4. Restricted uses
Redistribution and competing products
Do not resell, sublicense, publish, syndicate, pool, contribute, or make the data available as a directory, database, enrichment service, model-training corpus, or competing product unless the order expressly permits it.
Extraction and circumvention
Do not scrape, crawl, mirror, harvest, reverse engineer, evade quotas, reconstruct restricted source data, or use multiple accounts or automated methods to exceed the licensed scope.
Harmful or regulated decisions
Do not use EcosAtlas Data to determine an individual’s eligibility for employment, housing, credit, insurance, or another purpose governed by the Fair Credit Reporting Act, including as one input to that decision. Do not use it to make other legally significant decisions about an individual’s healthcare, law-enforcement treatment, or access to essential services. Human review does not override these purpose restrictions. Unlawful surveillance, discrimination, harassment, reidentification, and sensitive personal-trait inference are prohibited.
Misrepresentation
Do not remove material source or methodology context, present derived or matched information as verified fact, imply an endorsement, or claim rights, accuracy, or authority that the data does not provide.
5. Source and field restrictions
Source-specific access, attribution, retention, and redistribution requirements apply to the affected data. Material additional restrictions must be identified in the order or delivery documentation so the recipient can understand the licensed use. Normalization, linking, export, or AI processing does not remove source restrictions. EcosAtlas may withhold, correct, or withdraw affected fields when a right, source obligation, law, or agreement requires it, with notice and any delivery remedy specified by the order or required by law.
6. Personal information
Business records can contain identifiable professional information, and business use does not remove the privacy obligations that apply to it. For your downstream processing, follow applicable notices, lawful-use requirements, rights handling, security, retention, suppression, and outreach rules. Do not create consumer dossiers, locate people for personal surveillance, or combine professional records with sensitive or unrelated consumer information. The prohibited purposes in these Data Terms cannot be overridden by an informal request or a general grant of export rights.
7. Security and incident response
Protect EcosAtlas Data using safeguards appropriate to its sensitivity and volume. Limit access to authorized users; use access controls and secure transmission; protect exports and credentials; maintain reasonable logging, backup, and disposal practices; and require equivalent protection from approved contractors. Notify EcosAtlas promptly at hello@ecosatlas.com of unauthorized access, acquisition, disclosure, loss, or use affecting EcosAtlas Data and reasonably cooperate with containment and legally required response.
8. Quality, freshness, and verification
Coverage, identifiers, addresses, classifications, entity resolution, source availability, opportunity terms, and derived fields can change. A missing value is not proof that a fact does not exist; an observation date is not a promise that nothing changed later. Review documentation and confirm facts material to your business purpose. Acceptance criteria, correction or replacement procedures, and any refund remedy for an agreed delivery are specified in the order, subject to mandatory law. A general accuracy disclaimer does not override an express delivery commitment.
9. Samples, evaluations, and previews
Samples and evaluation data are provided to assess fit and may be limited, watermarked, capped, or outdated. Their scope and evaluation period must be identified when supplied. Unless expressly allowed, they may not be used in production, redistributed, retained after the evaluation period, used for outreach at scale, or combined to create a substitute dataset. An illustrative example must be clearly labeled and is not evidence of actual coverage.
11. Retention, deletion, and end of term
Keep licensed data only for the agreed duration and lawful purpose. When platform access ends, stop accessing that service. Retention of a separately delivered dataset or report follows its own order; it does not automatically end with platform access, nor does a one-time purchase imply perpetual data rights. At the end of the applicable data-license period, delete or return restricted data unless the order or law permits retention. Retained legal-hold or archival copies must remain protected and cannot be used for a new commercial purpose. Non-reversible aggregates and ordinary work product may be retained where they do not substitute for or disclose restricted data, subject to continuing source, privacy, and confidentiality duties.
12. Review and verification of compliance
EcosAtlas may request a written description or certification of authorized users, systems, sharing, security, retention, and deletion when reasonably necessary to investigate apparent misuse, satisfy a source obligation, or confirm compliance. If there is a material, credible concern, the parties will cooperate on a proportionate review that protects confidential information and avoids unreasonable disruption.
13. Remedies and survival
Unauthorized extraction, redistribution, reidentification, or disclosure can cause harm not fully remedied by money. EcosAtlas may suspend delivery, revoke access, require deletion, seek injunctive relief, or use other contractual and legal remedies. License restrictions, confidentiality, payment obligations, security duties, deletion duties, disclaimers, and liability terms survive as needed to give them effect.
14. Questions and requested rights
Before using data outside an existing order, describe the intended users, purpose, fields, systems, geography, sharing, retention, and output to hello@ecosatlas.com. Additional rights are effective only when confirmed in a written order signed by EcosAtlas.
